Por unanimidade, os três desembargadores da 3ª Turma entenderam que há risco de cometimento de novos crimes. Defesa argumenta que prisão se baseia somente no depoimento de um delator.
Tribunal Regional Federal da 1ª Região (TRF-1) decidiu nesta terça-feira (18) manter em prisão preventiva o ex-deputado Eduardo Cunha. Ex-presidente da Câmara, Cunha está preso desde outubro do ano passado em Curitiba.
No julgamento, a 3ª Turma do TRF-1 analisou decreto de prisão recente, determinada em junho pela Justiça Federal em Brasília, baseada nas operações Cui Bono e Sépsis, que apuram irregularidades na concessão de empréstimos pela Caixa com recursos do Fundo de Garantia por Tempo de Serviço (FGTS). Por unanimidade, os três desembargadores entenderam que a prisão preventiva deve ser mantida, em razão do risco de novos crimes, especialmente lavagem de dinheiro na movimentação de contas no exterior.
Além dessa prisão preventiva, Cunha é mantido encarcerado por outras três decisões judiciais: uma da Justiça Federal em Curitiba, outra da Justiça Federal em Natal, e uma terceira determinada pelo Supremo Tribunal Federal, em Brasília.
Assim, mesmo que obtivesse decisão favorável no TRF-1, ele ainda permaneceria preso no Paraná.
No julgamento desta terça, a defesa de Cunha alegou que não havia, no decreto de prisão de Brasília, ligação do ex-deputado com contas no exterior que receberam dinheiro.
A prisão, disse o advogado Délio Lins e Silva Júnior, se basearia exclusivamente na delação de um empresário que disse ter enviado propina para contas indicadas por Cunha.
Relator do pedido de liberdade, o desembargador Ney Bello levou em conta a acusação de que Cunha teria praticado o crime de lavagem por 321 vezes, apontando a habitualidade com que poderia esconder dinheiro em contas fora do Brasil.
“Só a existência dessas contas, com depósitos feitos a pedido de Eduardo Cunha, dá a segurança para dizer que há um processo continuo de lavagem de dinheiro”, afirmou no julgamento.
