Um procedimento administrativo contra a Companhia Hidro Elétrica do São Francisco (Chesf) foi instaurado pelo Programa Estadual de Proteção e Defesa do Consumidor (Decon) nesta quinta-feira (22). O procedimento decorre do apagão ocorrido na quarta-feira (21) que atingiu estados de todas as regiões do país. A Chesf já foi multada pelo Decon em decorrência dos apagões ocorridos em 10 de junho e 27 de novembro de 2015.
“A descontinuidade dos serviços essenciais, além de infringir os termos do Código de Defesa do Consumidor, gera demasiado transtorno aos consumidores”, afirma a promotora de Justiça Ann Celly Sampaio Cavalcante, secretária-executiva do Decon.
Transtornos
Segundo o Decon, o apagão ocasionou problemas à população, especialmente aos consumidores que dependem de energia para sobreviver – como os que necessitam de respiradores artificiciais ou outros equipamentos médicos que necessitam energia elétrica para funcionar.
Além disso, o longo período sem energia elétrica trouxe prejuízos financeiros para estabelecimentos comerciais – que deixaram de funcionar, perderam alimentos, não puderam efetuar vendas – instituições financeiras comprometendo, inclusive, o abastecimento de água e o trânsito da capital.
Ela explica que, caso fiquem comprovados o descumprimento do Código de Defesa do Consumidor e os problemas na prestação do serviço, a empresa pode ser penalizada com multas que variam de R$ 200 mil a R$ 3 milhões. “A penalidade vai depender do que ocasionou a falha. No procedimento, vamos apurar a responsabilidade de cada empresa. A partir daí, a multa será estabelecida”, completa.
Ann Celly Sampaio Cavalcante orienta que quem tiver sido prejudicado pelo apagão deve, antes de formalizar uma reclamação no Decon, procurar a plataforma Consumidor.gov.br ou diretamente a concessionária de energia elétrica, a Enel.
“A empresa, apesar de não estar comprovada a sua responsabilidade direta pelo problema, é responsável solidária e, por isso, deve instaurar procedimento para providenciar o ressarcimento do consumidor. Caso encontre alguma dificuldade em contatar a Enel ou em ser ressarcido, é que o cidadão deve formalizar uma reclamação no Decon”, informa.
