A Primeira Câmara do Tribunal de Contas do Estado do Ceará, em julgamento realizado na segunda-feira (21/5), considerou irregular a contratação temporária de duas servidoras pela Câmara Municipal de Altaneira no exercício de 2014. O motivo foi a falta de lei municipal estabelecendo os casos de contratação por tempo determinado, os quais, pela Constituição Federal, só podem ser admitidos para atender a necessidade excepcional de interesse público.
O fato foi apurado em decorrência de uma denúncia apresentada ao órgão, convertida no Processo de Tomada de Contas Especial de nº 3100/16. Seguindo voto da conselheira Patrícia Saboya, relatora da matéria, o colegiado determinou que a atual administração da Câmara tome as devidas providências quanto às servidoras caso ainda estejam em situação irregular.
Dentro do prazo legal, a então gestora pode apresentar recurso. Caso as eventuais justificativas não sejam suficientes para reverter a decisão, a responsável terá seu nome incluído em relação de gestores com contas desaprovadas pelo TCE, o que pode impedi-la de ocupar cargos públicos.
No curso do processo, após constatar a situação por meio do Sistema de Informações Municipais (SIM), o Tribunal solicitou a lei autorizativa, os contratos de admissão e respectivos termos aditivos, e a comprovação do evento extraordinário. Todavia, embora notificada regularmente, a ex-gestora não apresentou defesa nem documentos.
Nas razões de seu voto, a relatora argumentou que “o regime jurídico especial da contratação por excepcional interesse público exige lei autorizativa do ente federativo, nos moldes da Lei Federal nº 8.745/93”, e que, “assim, os requisitos para referido contrato são: lei autorizativa, temporariedade do contrato e o excepcional interesse público”.
