O tribuna Regional Federal da 4.ª Região (TRF-4), mandou soltar ainda neste domingo (8) o ex-presidente Lula, que está preso na sede da Polícia Federal em Curitiba desde 7 de abril do corrente ano.
A liminar de Favreto atendeu a pedido de habeas corpus apresentado na sexta-feira (6) pelos deputados petistas Wadih Damous, Paulo Pimenta e Paulo Teixeira. Eles argumentaram que não haveria fundamento jurídico para a prisão dele.
No alvará de soltura, o desembargador determinou ao diretor da Polícia Federal em Curitiba para pôr “incontinenti em liberdade” o ex-presidente.
Segundo o magistrado, há um fato novo na condição do réu, que é a pré-candidatura à Presidência da República.
“Tenho que o processo democrático das eleições deve oportunizar condições de igualdade de participação em todas as suas fases com objetivo de prestigiar a plena expressão das ideias e projetos a serem debatidos com a sociedade. Sendo assim, percebe-se que o impedimento do exercício regular dos direitos do pré-candidato, ora paciente, tem gerado grave falta na isonomia do próprio processo político em curso, o que, com certeza, caso não restabelecida a equidade, poderá contaminar todo o exercício cidadão da democracia e aprofundar a crise de legitimidade, já evidente, das instituições democráticas”, diz a decisão.
