Após mais de nove horas de impasse no Judiciário, o presidente do Tribunal Regional Federal (TRF) da 4ª Região, Carlos Eduardo Thompson Flores Lenz, manteve a prisão do ex-presidente Luiz Inácio Lula da Silva, colocando fim ao confronto de decisões dos desembargadores Rogério Favreto e João Pedro Gebran Neto. O conflito de competência envolvendo o TRF chegou ao Supremo Tribunal Federal (STF). Em nota a presidente da Corte, ministra Cármen Lúcia, disse que a Justiça precisa decidir com rapidez, mas “sem quebra da hierarquia” e mantendo “o rigor absoluto no cumprimento das normas vigentes”.
Em seu despacho, Thompson Flores afirmou que os argumentos usados no pedido de habeas corpus a favor do ex-presidente são os mesmos já submetidos e analisados pela 8ª Turma do TRF, inclusive o fato de Lula ser pré-candidato à Presidência da República. Segundo ele, “rigorosamente, a notícia da pré-candidatura eleitoral (de Lula) é fato público/notório do qual já se tinha notícia” no julgamento da 8ª Turma. O presidente do TRF foi provocado pelo Ministério Público Federal, que argumentou que a situação gerava insegurança jurídica.
Na decisão, Thompson deixou claro que Favreto, como plantonista do TRF, não tinha competência para liberar o ex-presidente. Ao revogar a decisão de Favreto, o presidente do TRF mandou devolver os autos do processo ao gabinete de Gebran Neto, bem como informar a Polícia Federal de seu despacho.
