Do lado do Supremo, a canetada de Fux escancarou que houve uma troca. Ao revogar o benefício que ele mesmo havia estendido aos colegas, o ministro restabeleceu o óbvio: não faz sentido o Estado pagar auxílio-moradia a juízes que têm imóvel próprio na comarca em que trabalham.
O curioso é que Fux não via problema no penduricalho até ontem. Bastou o aumento sair para que ele passasse a considerá-lo inadequado. “A Constituição é um documento vivo, em constante processo de significação e ressignificação”, justificou o ministro. Pode ser, mas certas autoridades são mais vivas do que qualquer documento.
