O plenário do Supremo Tribunal Federal (STF) negou, na madrugada desta quinta-feira (05), o habeas corpus da defesa do ex-presidente Luiz Inácio Lula da Silva (PT). Os ministros da Corte decidiram, por 6 votos a 5, que o ex-presidente poderá ser preso caso se esgotem os recursos da segunda instância, representada pelos desembargadores do Tribunal Regional Federal da Quarta Região (TRF-4), que condenaram o petista na Operação Lava Jato.
O placar foi de 6 votos contra o habeas corpus contra 5 a favor. Gilmar Mendes, Dias Toffoli, Ricardo Lewandowski, Marco Aurélio e Celso de Mello votaram a favor habeas corpus, enquanto Fachin, Moraes, Barroso, Rosa Weber e Fux foram contra. A presidente da casa, ministra Cármen Lúcia, desempatou o pleito, que durou mais de dez horas.
