Relator da Lava Jato em segunda instância determina que Lula seja mantido preso
Desembargador federal Rogério Favreto, que é plantonista do TRF-4, havia determinado liberdade a Lula.
O desembargador federal João Pedro Gebran Neto, relator dos processos da Lava Jato em segunda instância, determinou que não seja cumprida a decisão do plantonista Rogério Favreto, que mandou soltar o ex-presidente Luiz Inácio Lula da Silva.
“DETERMINO que a autoridade coatora e a Polícia Federal do Paraná se abstenham de praticar qualquer ato que modifique a decisão colegiada da 8ª Turma”, diz o texto.
Na manhã neste domingo (8), o desembargador federal plantonista Rogério Favreto decidiu conceder liberdade a Lula. Lula foi condenado no processo do triplex, no âmbito da Operação Lava Jato, por corrupção passiva e lavagem de dinheiro.
Em seguida, o juiz Sérgio Moro afirmou que o desembargador não tem competência para mandar soltar Lula. De acordo com o magistrado, caso ele ou a autoridade policial cumpra a decisão, estará “concomitantemente” descumprindo a ordem de prisão do Colegiado da 8ª Turma do TRF-4.
No início da tarde, o procurador regional da República plantonista José Osmar Pumes se manifestou. Ele pediu a reconsideração da decisão sobre o pedido de soltura de Lula.
“O Ministério Público Federal requer que seja reconsiderada a decisão liminar, para que seja suspensa a determinação contida no evento 3, recolhendo-se o alvará de soltura, até que o pedido de habeas corpus aqui tratado seja submetido ao escrutínio da c. 8ª Turma dessa Corte”, apontou o procurador.
